CAMINO GARDENS APPEARANCE COMMITTEE

The Appearance Committee of Camino Gardens is comprised of three Section Chairpersons, each of which is a member of the Board of Directors and appointed by the President.

Appearance Chairperson Responsibilities

Each Section Chairperson is responsible for one of the Sections designated on the map shown on page 4. Each Section Chairperson is responsible for appointing an alternate if he or she is unable to perform their duties. In addition, the following are responsibilities of each Appearance Chairperson:

Monthly Inspections
  1. Make a monthly inspection of his or her section to determine that:
    1. Roofs are kept white, in good condition and need no cleaning, painting, or visible repairs.
    2. Lawns and swales are maintained.
    3. Bushes and hedges are trimmed and there are no dead trees on the lawn or swale.
    4. There is no obstruction to sidewalk pedestrians (untrimmed hedges or vehicles parked across the sidewalk)
    5. Houses are properly maintained, paint, garage doors, driveway, and walkways are in good condition.
    6. There are no illegal structures, vehicles, or signs on the property, vehicles, swales, or median strips. One "House For Sale" sign may be displayed in one front window, provided the sign is no larger than 10"x 14" in size.
    7. There are no nuisances or athletic equipment on the property (debris, clothes lines, basketball hoops, etc.).
    8. No vans are to be left outside (such vehicles must be parked in closed garages at all times). No trucks, commercial vehicles, agricultural, construction, or industrial equipment are permitted except as necessary for brief periods while services are being performed. Vehicles in excess of a garage’s capacity can then be parked in the driveway. Under no circumstances shall any vehicle be parked on the lawn. Homeowners should ask guests to park their cars half on the swale and half in the street to avoid blocking streets.
    9. Moving sales are only allowed with the written permission of the Board of Directors. Residents are only permitted to have one such sale during their residency in Camino Gardens (normally just prior to moving). No signs may be displayed in Camino Gardens for such sales, and all items for sale should be stored and displayed in the home or garage with the door open. In order to be considerate of your neighbors, the Board would appreciate it if such sales could be limited to one day only.

Complaints
  1. If the Section Chairperson receives any complaints or reports concerning the violation of any of the aforementioned (a through h) items, he or she shall conduct a timely investigation of the complaint and take appropriate action if in his or her judgment the complaint is justified. Section Chairpersons should be concerned, however, only with violations to Camino Gardens covenants relating to APPEARANCE. Neither the Board of Directors nor the Appearance Committee shall attempt to settle unrelated disagreements among neighbors, i.e., trimming of trees near property lines, etc., beyond any of the aforementioned (a through h) items.
Violations
  1. If a homeowner is found to be in violation of any of the aforementioned (a through h) items, or if the property shows any other significant evidences of neglect, the following action will be taken:
    1. Letter #l (Exhibit A) is sent to the homeowner without delay, and the Board Secretary is given a list of such offenders at the next Board meeting.
    2. If any violations continue beyond 30 days from the date of Letter #1, Letter #2 (Exhibit B) is sent and the continued violation is brought to the attention of the Board at its next meeting.
    3. If the violation continues beyond 30 days from the date of Letter #2, a certified Letter #3 (Exhibit C) is sent notifying the defaulter that he or she will be assessed for all legal and related costs if the violation is not corrected.
  2. Homeowners with an outstanding appearance violation will not be granted approval for architectural modifications until the appearance violation has been corrected.
Annual Inspections
  1. Make an annual inspection with all three Section Chairpersons, President, and Vice President (touring together) to ensure that criteria and maintenance standards (items a through h) are uniform.
  2. Make an annual inspection by boat (all three Section Chairpersons, President, and Vice President cruising together) of all the canals in Camino Gardens, to inspect the sea walls, docks, and rear yards to determine that:
    1. Sea walls and docks are in satisfactory condition.
    2. Roofs are white, in good condition and need no cleaning, painting, or repairs.
    3. Lawns are maintained, bushes and hedges are trimmed, there are no dead trees.
    4. Houses and patios are properly maintained, patio screening is intact, etc.
    5. There are no illegal structures on the property or signs at the rear of any property ("For Sale" signs on the dock, etc.).
    6. There are no nuisances on the property (debris, visible clothes lines, etc.).
    7. The drainage ditch on SW 9th Ave. between 7th and 8th Streets and the canal at the western end of Apple Tree Lane should be inspected and the Lake Worth Drainage District (13081 N. Military Trail, Delray Beach, FL 33445) should be notified by the Board of Directors if cleaning is necessary.
Monthly Reports
  1. At each meeting of the Board of Directors, each Section Chairperson should give to the Secretary in writing the names of all those to whom any letters were sent during the month and the reasons for having sent them. If any legal letters have been sent, copies of all such letters must be given to the Secretary to be retained in the defaulter's file.

Camino Gardens Directory Delivery

  1. Each Section Chairperson shall be responsible to see that prompt delivery of the annual Camino Gardens directory is made to all residents in his section once the updated version has been completed each year.

  1. The map presented on the following page is a convenient guide to locations of properties and indicates the properties in each section (127 properties in Section 1, 113 properties in Section 2, 181 properties in Section 3).

May we ask for your cooperation? During a recent review of the homes in Camino Gardens, the Appearance Committee of the Board of Directors found that there is a potential problem with your home.

If you have any questions regarding this problem, please refer to the Camino Gardens Declarations of Restrictions' and pages 8 and 9 in your current Camino Gardens Directory.

We request that you correct this situation as promptly as possible. In order that we might reply to complaints of any neighbors, please inform the Committee by mail to the above address with your intended actions and a date by which we can expect the situation to be remedied.

We feel that one of the primary reasons we ad chose Camino Gardens as our neighborhood is the attractive appearance and the apparent willingness of our residents in maintaining their property in conformance with our "Summary of Deed Restrictions." Camino Gardens needs your help now in maintaining our high standards in appearance.

The Appearance Committee of the Camino Gardens Association, Inc., sent you a letter on requesting that the unsatisfactory appearance of your be corrected. A subsequent review by this same Committee reveals that the condition continues to exist.

We would appreciate hearing from you by of your plans to correct this condition. You may wish to refer to the Deed Restrictions and By Laws of Camino Gardens to review your obligations to maintain your property in a satisfactory manner. The Board of Directors is mandated to take action if this condition is not corrected within a reasonable time.

Dear Homeowner:

Once again, the Board of Directors of the Camino Gardens Association, Inc., is notifying you that the problem of your which prompted our letters of __ and have yet to be rectified by you.

We strongly urge you to abide by the Appearance Standards of Camino Gardens Association, Inc. dated February 1996, under which the Board is acting, so that this problem may be put to rest. We would appreciate it if you would notify us by as to how you plan to correct the problem within thirty (30) days from the date of this, our third letter.

Your failure to take corrective action will leave the Board no alternative but to turn this matter over to legal counsel for resolution In addition to any expenses you may incur in correcting the problem, all court costs, legal fees, and expenses connected therewith, may be charged against you and would become a lien on your property.

To avoid further actions by the Board, please give this notice your urgent attention.
